Report of joint inspection team in compliance to the National Green Tribunal order of November 1, 2019 in Original Application No. 967/2019 in the matter of Kailash Nath Soni Vs State of Uttar Pradesh.

A joint committee visited the site of M/s Bhawani Rolling Job Works, Baheliya Ki Gali, Ganeshganj city, Mirzapur, Uttar Pradesh to seek factual position. Grievance against the unit was that it was causing pollution. During inspection, it was noted that the industry was using fire wood as fuel for the 'tappai bhatti'. Around 600 kg of wood per day was used. The industry had not installed air pollution control system and stack on tappai bhatti to control flue gas emission. Further, the industry was established in a densely populated area of Mirzapur city and in its south direction, there is a school.

The Uttar Pradesh Pollution Control Board (UPPCB) had not issued consent to establish and consent to operate to the industry. The SPCB had issued closure order against the industry and the industry has submitted an affidavit on February 20, 2020 regarding closure of production in compliance of UPPCB order.

The Committee recommended that the industry should strictly comply with the order of UPPCB and the district administration, Mirzapur must ensure that the industry should not operate in the densely populated area.
