Order of the National Green Tribunal in the matter of Satyanarayan Upadhyaya Vs Union of India & Others dated 20/07/2020.

Grievance in this application is against cutting of trees in Kasganj District, Uttar Pradesh. The applicant has also prayed that transplantation machine should be used and instead of cutting the trees, the same be transplanted at other locations.

It is mentioned that the State of Uttar Pradesh was widening roads from Soron, Kasganj to Etah and from Soron, Kasganj to Patiyali, Kasganj, Uttar Pradesh and without any application of mind the State Government has already cut down approximately 3000 trees across roads from Soron, Kasganj to Etah and is now in process of cutting down approx. 7230 more trees on the way between Soron, Kasganj and Patiyali, Kasganj, Uttar Pradesh ignoring the environment and its effect.

Such action is against National Forest Policy, 1988 read with the provisions of Environment (Protection) Act, 1986 and Forest (Conservation) Act, 1980.

The NGT directed submission of a factual and action taken report from Principal Chief Conservator of Forests (Head of Forest Force), Uttar Pradesh and the Uttar Pradesh State Pollution Control Board within three months.
