Order of the National Green Tribunal regarding effluents discharged into sea from Jhagadia, Bharuch, Gujarat, 31/10/2019

Order of the National Green Tribunal in the matter of Jayesh Patel, Secretary, Narmada Pradushan Nivaran Samitee, Ankleshwar Vs State of Gujarat dated 31/10/2019 regarding effluents being discharged into the sea through a pipeline from Jhagadia to Kantiyajal in violation of environmental norms.

The effluents discharged do not meet the prescribed norms and there is violation of Water Act 1974, Environment Protection Act 1986 and the CRZ Notification 2018. Also, conditions of consent requiring establishment of guard pond was also not followed, as well as violation of standards for marine discharge posing threat to the coastal environment.

The NGT directed a Joint Committee to be constituted comprising of Central Pollution Control Board (CPCB), Gujarat Coastal Zone Management Authority (GCZMA) and Gujarat State Pollution Control Board (State PCB) to look into the matter and take action in accordance with law and submit a report within one month.
