  • 21/05/2019

Order of the National Green Tribunal in the matter of Praduman Tiwari Vs Union of India & Others dated 21/05/2019 regarding cancelling of authorization in favour of Ferro Build Hards (I) Pvt. Ltd., Naini, Allahabad, (Pragyaj), Uttar Pradesh. Grievance in this application is that the plant in question is very close to residential area, river bed, railway track and highway. In spite of unsuitable location, UPPCB has granted authorization under the provisions of Bio-Medical Waste Management Rules, 2016 in violation of guidelines issued by the CPCB in the year 2003.

M/s Ferro Build Hards (I) Pvt. Ltd. has stated that plant has been now modernized and no pollution is caused. The UPPCB justified the authorization on the ground that very few common bio-medical waste treatment facilities are available.

NGT directs a joint report to be submitted by the CPCB and UPPCB within a month to ascertain the latest status of compliance of environmental norms by functioning of the plant particularly in view of the fact that it is located in the flood plains and in the vicinity of habitation.
