Order of the National Green Tribunal in the matter of K. Lakshma Reddy Vs M/s Siddi Vinayaka Oil Mill & Others dated 15/03/2019. The issue for consideration is the inaction of the Telangana State Pollution Control Board (TSPCB) in considering the pollution issues raised before it with reference to complaints against the polluting units. The polluting units are Frigerio Conserva Allana Ltd., Algole Road, Zahirabad, Piramal Enterprises Ltd. Digwal, Kohir Mandal, and Sri Siddi Vinayaka Oil Mill, Zahirabad, Sangareddy District, Telangana State.

The report of the TSPCB shows that the industries have high pollution potential. In such circumstances, on the ‘Precautionary Principle’ of environmental law, the TSPCB must undertake continuous monitoring even after norms are claimed to have been achieved said NGT. The Tribunal justified the association of Central Pollution Control Board (CPCB) with the TSPCB in monitoring. Similarly in the assessment of damages, it is desirable that the representative of CPCB is associated. The TSPCB would file further action taken report in the matter after three months.
